Many live in homes passed down through the generations, but the public record does not reflect that they have an interest in the property. If title is incorrect, seniors are unable to sell their homes, refinance, claim property tax exemptions for which they qualify, or draw from the equity to make needed repairs. They are also unable to apply for emergency funds that may be available to them such as though the City of Chicago Roof and Porch Repair Program or the Emergency Heating Repair Program. In addition to her son, Isabella’s support network includes her daughter, granddaughter and boyfriend. To Isabella, family is very important. She is very proud of her children and grandchild. Over the years, Isabella has had many legal issues with which she could use help, but she thought she would have to accept her life the way it was because she did not have the funds to hire an attorney. He also deeply enjoys learning new languages and how each language compares to another. He even has taught himself songs to sing in Polish! When Isabella asked Nick once if he would like to live alone without her, he could not even imagine the possibility. He wants to be close to his mom and always checks in on her to make sure she is doing well. “My son is so peaceful and caring. He’s like my right hand. He needs me to help him with the tasks of daily life. She quickly realized just how important estate planning documents are. “They explained everything to me, so I went for it. You never know what could be coming in the future or what the future holds for you.” Estate planning through executing her power of attorney and will made her feel an overwhelming sense of peace for her and her family. “It makes me feel at peace that if anything happens, I don’t have any loose ends and that everything is taken care of. I wanted to make sure that if anything happens to me, my daughter and granddaughter can say, ‘Grandma took care of this.’” Isabella wishes she and her family knew about estate planning when her mother passed. “When my mom died, she didn’t know she could [do] all of this. When she passed away, nothing was taken care of. I am glad that I took these steps and learned about these things. I can now pass this information to someone else.” Upon getting this done for herself, Isabella made sure to instill how necessary it is for her daughter and granddaughter to get this taken care of for themselves and their family. “You don’t want to make your family members wonder what or how to take care of these things. She has been an elder law attorney her entire career with a focus on estate planning, probate, guardianships for people with disabilities and Medicaid planning. Within a couple years of becoming an attorney, Mollie started looking for volunteer opportunities with legal service organizations. She found CDEL through the Chicago Bar Association's Serving Our Seniors Committee. They had a joint program with CDEL where attorneys would prepare POA documents for low income seniors. In her current role as Guardianship Advisor at Fifth Third Private Bank, Molly works with families and attorneys to ensure her clients are well cared for financially while prudently managing their income and assets to create long term financial stability and growth. Molly counts herself fortunate to work with and learn from a team of experienced individuals who have also devoted their careers to protecting those most at risk. Acting as a liaison between families and the legal system in her professional role served to highlight the disadvantages that may be felt by families who could not afford to retain professional services; Molly sought non-attorney volunteer opportunities at CDEL to try and mitigate those disadvantages. At CDEL, she started by helping out at the senior clinics and then got involved at the Guardianship Help Desk at the Daley Center. The Guardianship Help Desk closed down during COVID, and when it reopened last year, she was glad to be back at the desk. “The attorneys at CDEL make it easy to volunteer. Hoping to reach community members before legal capacity is lost, CDEL carefully approaches the topic and has developed culturally connective programming for three populations: Black-African American, Latino/a/e-Hispanic, and LGBT+. The Power of Planning also aims to support and educate family and friends in their new roles as caregivers and agents. Individuals living with early-stage dementia can gain tremendous peace of mind for themselves, and their family and friends, by creating advance planning documents and making their wishes clear. Qualifying candidates are given the opportunity to meet with an attorney at a later date to make their power of attorney documents. A key focus of Power of Planning is partnering with trusted organizations in each community to overcome barriers of mistrust and ensure that everyone learns how advance planning is a tool they are entitled to use.
